Terms of Service - AiyuChat

1. Acceptance of Terms

Welcome! These Terms of Service are an agreement between you and AiyuChat, covering the AiyuChat website ("Website") and mobile application ("App"). In these Terms, we refer to AiyuChat as "we," "App," or "Platform," and collectively refer to the Website and App as the "Services."

These Terms govern your access to and use of the Services. Please read them carefully, as they include important information about your legal rights. By accessing or using the Services, you agree to these Terms. If you do not understand or agree to these Terms, please do not use the Services.

2. Description of Service

AiyuChat is an AI-powered conversational assistant application that provides voice chat, text chat, and multimodal interaction features. The App connects to AI services provided by third-party providers to generate responses to your queries.

You understand and agree that:

AI responses are for informational and entertainment purposes only
AI responses should not be relied upon for medical, legal, financial, or other professional advice
You are responsible for evaluating the accuracy and usefulness of any content
The developer is not liable for any decisions made based on AI-generated content

3. Account Registration

3.1 Registration Obligations

To use AiyuChat, you must register an account using authentication methods we support (such as Google, Apple OAuth, etc.). When registering, you agree to provide accurate and complete information.

Age Requirement: You must be at least 13 years old to use this App. If you are under 18, you must have parental consent to use the App.

3.2 Account Security

You are responsible for:

Maintaining the security of your account credentials
All activities that occur under your account
Immediately notifying us of any unauthorized use

We will not be liable for any loss or damage arising from your failure to comply with this provision.

3.3 Storage and Data Limits

You acknowledge that we may establish general practices and limits concerning use of the Services, including maximum retention periods for data and maximum storage space on our servers. We reserve the right to terminate accounts that are inactive for extended periods.

4. User Conduct

4.1 Prohibited Content

You are solely responsible for all content you submit to the Services. You agree not to submit any content that:

Infringes any intellectual property or other proprietary rights
You do not have a right to submit
Contains software viruses or malicious code
Poses a privacy or security risk to any person
Constitutes spam, advertising, or promotional materials
Is threatening, abusive, harassing, or bullying
Depicts excessive or realistic serious violence
Is defamatory, libelous, or intentionally false
Constitutes hate speech based on race, ethnicity, gender, religion, etc.
Is obscene or pornographic
Constitutes sexual harassment or exploitation
Glorifies or provides instructions for self-harm or suicide
Promotes terrorism or violent extremism
Promotes criminal activity
Facilitates illegal drug transactions
Claims to provide professional medical, legal, or financial advice
Impersonates others or provides false information

4.2 Prohibited Activities

You agree not to:

Violate any applicable laws or regulations
Impersonate any person or entity
Solicit personal information from anyone under 18
Collect other users' contact information for spam
Obtain information through means not intentionally made available
Rent, sell, or sublicense any part of the Services
Attempt to circumvent technological protection measures
Reverse engineer, decompile, or disassemble the Services

4.3 Voice/Video Features

If you use voice or video features, you agree not to:

Upload recordings of real people without their consent
Use any feature to create "deepfakes" or impersonate real persons
Submit recordings that violate the above conduct rules

4.4 Content Moderation

We reserve the right to investigate and take appropriate action against anyone who violates these provisions, including restricting content visibility, removing content, suspending or terminating accounts, and reporting to law enforcement.

We use automated and manual measures to identify activities that may be illegal or violate these Terms. You can report violations through the App's reporting feature.

5. Intellectual Property

5.1 Your Content

When you submit content to the Services, you represent and warrant that you own all rights in that content, or have obtained all necessary permissions and authorizations.

You retain ownership of content you submit. You grant us a nonexclusive, worldwide, royalty-free, transferable, sublicensable, perpetual, irrevocable license to copy, display, upload, distribute, store, modify, and use the content for any AiyuChat-related purpose, including operating and improving the Services.

5.2 AI-Generated Content

When you generate content using the Services (such as AI responses, conversations), as between you and AiyuChat, you own that generated content. You grant us the same license as above to provide and improve the Services and AI models.

5.3 Services Content and Trademarks

The App's design, code, graphics, and trademarks are owned by the developer. You may not use AiyuChat trademarks without written permission.

5.4 Third-Party Content

We are not responsible for third-party content. AI-generated conversations are unpredictable and may produce inaccurate or offensive content. You must evaluate and bear all risks associated with using any content.

5.5 Copyright Complaints

If you believe your work has been infringed, contact us at: support@aiyu.chat

Your notice must include:

Your contact information (name, address, phone, email)
Description of the infringed work
Description of where infringing content is located
A statement that you have a good faith belief the content is unauthorized
A statement under penalty of perjury that you are the copyright owner or authorized representative

We will investigate and take appropriate action. Repeat infringers will have their accounts terminated.

6. Paid Subscriptions

6.1 Billing

If you purchase paid Services, you must provide a valid payment method. Subscriptions will automatically renew and charge your payment method periodically until you cancel.

Subscriptions are processed through Apple App Store. Refund requests must be submitted through Apple App Store: Apple App Store Refunds

6.2 Cancellation

You may cancel your subscription at any time. Payments are non-refundable unless required by law. After cancellation, you may continue using the Services until your current subscription period ends.

6.3 Price Changes

We may change prices. If we increase subscription prices, we will provide 30 days' notice, and the increase will take effect at your next renewal so you may cancel if you disagree.

6.4 Feature Changes

Features and functionality of paid Services may change at any time without prior notice.

7. Third-Party Links

The Services may contain links to third-party websites or services. We have no control over such sites and are not responsible for their content or practices. You acknowledge that we will not be liable for any damage or loss arising from use of any third-party website or service.

8. Indemnification

You agree to release, indemnify, and hold AiyuChat and its employees, directors, and agents harmless from any and all losses, damages, and expenses arising out of or relating to your use of the Services.

9. DISCLAIMER OF WARRANTIES

YOUR USE OF THE SERVICES IS AT YOUR SOLE RISK. THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS.

WE EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, INCLUDING BUT NOT LIMITED TO:

IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE
THAT THE SERVICES WILL MEET YOUR REQUIREMENTS
THAT THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE
THAT RESULTS OBTAINED FROM THE SERVICES WILL BE ACCURATE OR RELIABLE

10. LIMITATION OF LIABILITY

YOU UNDERSTAND AND AGREE THAT WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING LOSS OF PROFITS, GOODWILL, DATA, OR OTHER INTANGIBLE LOSSES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT WILL OUR TOTAL LIABILITY TO YOU EXCEED: THE AMOUNT YOU PAID AIYUCHAT (IF ANY), OR $100.

Some jurisdictions do not allow exclusion of certain warranties or limitation of liability, so some of the above limitations may not apply to you.

11. Service Modifications and Termination

11.1 Service Changes

We reserve the right to modify, suspend, or terminate the Services or any part thereof at any time without notice. Features may be added, changed, or removed.

11.2 Account Termination

Your account may be suspended or terminated if you violate these Terms. Upon termination, we may immediately delete your account and related data.

Termination of your account does not terminate our rights to your content.

12. Governing Law and Jurisdiction

These Terms are governed by United States law, without regard to its conflict of law provisions. For any disputes or claims, you and we agree to submit to the jurisdiction of courts in the United States.

13. Dispute Resolution and Arbitration

13.1 Arbitration Agreement

YOU AGREE THAT ANY DISPUTE OR CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES SHALL BE RESOLVED BY FINAL AND BINDING ARBITRATION, NOT IN COURT. Arbitration will take place in the United States, before a single arbitrator. The arbitrator's decision may be enforced by any court with jurisdiction.

13.2 Class Action Waiver

YOU AGREE NOT TO PARTICIPATE IN CLASS ACTIONS, CLASS ARBITRATIONS, OR REPRESENTATIVE ACTIONS AGAINST US. Any dispute must be resolved on an individual basis, and may not be combined with claims of other users.

13.3 Arbitration Exceptions

The following disputes are not subject to the arbitration agreement: (a) claims in small claims court, so long as the dispute amount falls within that court's jurisdiction; (b) intellectual property disputes; (c) requests for injunctive relief that a court can issue.

14. Miscellaneous

14.1 Entire Agreement

These Terms constitute the entire agreement between you and us, superseding any prior agreements regarding the Services.

14.2 Severability

If any provision of these Terms is found invalid by a court, the parties agree the court should try to give effect to the parties' intentions, and other provisions remain in effect.

14.3 No Waiver

Our failure to exercise any right or provision does not constitute a waiver of that right or provision.

14.4 Expiration of Claims

You agree that any claim arising from use of the Services must be filed within one year after the claim arose, or be forever barred.

14.5 Assignment

You may not assign these Terms without our prior written consent. We may assign or transfer these Terms without restriction.

14. Changes to Terms

We reserve the right to change or modify these Terms at any time. Material changes will be posted on this page with the last revision date at the top.

Material changes will become effective 30 days after posting, except changes addressing new features or legal requirements will be effective immediately. Your continued use after changes become effective constitutes acceptance of the new Terms.
